Terms of Service
These Terms of Service (“Terms”) govern the use of the CacheWood Mobile website and services offered by CacheWood Mobile LLC, a Florida limited liability company doing business under the CacheWood Mobile brand (“CacheWood,” “CacheWood Mobile,” “we,” “us,” or “our”). By using our website, submitting an evaluation request, entering into a transaction with CacheWood Mobile LLC, shipping a device to us, or electronically accepting an agreement, you agree to these Terms and any applicable transaction agreement.
Effective Date: August 22, 2026
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to sell a device to CacheWood or authorize CacheWood to sell a device on your behalf.
2. Preliminary Evaluations Are Not Final Offers
Any preliminary estimate, evaluation, expected value, commission discussion, or transaction discussion is not a guaranteed final offer. Final eligibility, compensation, commission, and transaction terms depend on receipt, inspection, and verification of the actual device, including its identity, condition, ownership, financing or lease status, carrier status, lost/stolen status, account locks, device-management restrictions, repair history, and other relevant eligibility factors. If the device materially differs from what was represented, CacheWood may revise or decline the transaction.
3. Accuracy of Information
You agree to provide complete and accurate information about yourself and the device and not to omit or misrepresent material facts affecting ownership, legality, financing, condition, functionality, insurance status, locks, or resale.
4. Ownership and Authority
You represent that you are the lawful owner or are legally authorized to transfer the device; that the device is not stolen; and that there are no undisclosed liens, leases, financing obligations, ownership claims, insurance claims, or other restrictions affecting the transfer.
5. Device Verification
CacheWood may verify IMEI, serial number, carrier status, lost/stolen status, account-lock status, financing information where available, and other relevant device information. CacheWood may request supporting documentation and may delay, revise, investigate, or reject a transaction where eligibility concerns exist.
6. Personal Accounts and Device Data
You are responsible for backing up data, signing out of personal accounts, disabling Apple Find My and Activation Lock where applicable, removing Google accounts and Android FRP, removing other applicable account locks, and completing any requested factory reset. CacheWood is not responsible for personal data you fail to preserve before transferring the device.
7. Shipping to CacheWood
For approved transactions, CacheWood may provide a prepaid shipping label and shipping instructions. You must follow all packaging, labeling, safety, and shipping instructions. Shipping labels supplied by CacheWood are intended to include applicable insurance or declared-value protection. If a shipment is lost, payout may be withheld until the carrier confirms the loss and the applicable claim is approved and paid. CacheWood is not liable for a denied or unpaid claim to the extent the owner directly or indirectly caused or materially contributed to the loss, including through fraud, criminal conduct, false shipment information, tampering, prohibited contents, or material failure to follow shipping instructions.
8. Damage From Inadequate Packaging
CacheWood is not responsible for damage occurring while a device is shipped from the owner to CacheWood to the extent the damage results from improper or inadequate packaging, inadequate impact or moisture protection, an unsuitable shipping container, or failure to follow CacheWood’s packaging instructions.
9. Direct Buyout
Under a Direct Buyout, CacheWood Mobile LLC purchases an eligible device directly from the owner. The final purchase amount will be stated in the transaction agreement. After the device is delivered, inspected, and successfully verified, payment is issued 3 business days after delivery. Available payout methods may include Zelle, Cash App, PayPal, Venmo, or ACH bank transfer, subject to availability and applicable law. The customer may choose from the methods then offered by CacheWood.
10. Sell-It-for-You Transactions
The original owner retains ownership during the selling period, subject to these Terms. The owner authorizes CacheWood to possess, prepare, photograph, advertise, list, market, ship, and sell the device through any lawful online or in-person marketplace, platform, sales channel, or other venue through which electronic devices may reasonably be sold.
11. Minimum Sale Price and Commission
The transaction agreement will state the owner’s minimum authorized sale price. CacheWood may sell at that amount or higher. The owner may revise the minimum before a Committed Sale by written email or letter; a written revision received by CacheWood supersedes the earlier minimum without requiring a re-executed agreement. CacheWood’s commission will be stated in the transaction agreement after the device is received, inspected, and verified and may generally range from 20% to 30%. Verbal or preliminary commission discussions are nonbinding until documented in writing.
12. Net Proceeds and Owner Payout
Unless otherwise stated in the transaction agreement, the owner’s payout is based on net transaction proceeds after applicable marketplace or selling-platform fees, payment-processing fees, authorized advertising or promotional fees, shipping from CacheWood to the end buyer, shipping from the owner to CacheWood, and other specifically authorized transaction expenses. CacheWood’s agreed commission is then applied according to the transaction agreement.
13. Committed Sale
A Committed Sale occurs when an end buyer has submitted payment and CacheWood becomes obligated through the applicable marketplace or sales channel to fulfill the order. Once a Committed Sale occurs, the original owner may no longer revoke the transaction or require CacheWood to cancel the sale.
14. Successful Delivery and Payout
A Sell-It-for-You payout does not become due merely because a buyer places an order or pays. The buyer must successfully receive the device. Once the device has successfully sold and been delivered to the end buyer, payout is issued 3 business days after delivery.
15. Cancellation, Refused Delivery, or Failed Delivery
CacheWood assumes downstream buyer-return and resale risk only after successful delivery. If the buyer cancels before delivery, refuses delivery, the shipment is returned before successful delivery, or the sale otherwise fails before delivery, no payout becomes due and the device remains under the original Sell-It-for-You arrangement and may be relisted.
16. Owner Termination and Return Requests
The owner may terminate a Sell-It-for-You arrangement before a Committed Sale by written email or letter. CacheWood must be allowed 1 business day after receipt to process the request. Submitting the request does not instantly freeze all listings. If a Committed Sale occurs during that one-business-day processing window before CacheWood finishes processing the request, the sale will stand.
17. Buyer Returns After Successful Delivery
After successful delivery and once the owner’s payout right has arisen, CacheWood assumes the ordinary downstream commercial risk of a subsequent buyer return, refund request, payment dispute, chargeback, marketplace claim, or need to resell the device. These ordinary downstream events will not by themselves reduce or reverse the amount otherwise payable to the owner.
18. Owner Misconduct Exception
CacheWood does not assume losses arising from or materially caused by the owner’s fraud, intentional misrepresentation, materially inaccurate device description, undisclosed financing or lease obligation, false ownership representation, undisclosed lost/stolen status, fraudulent insurance activity, undisclosed account or activation lock, undisclosed device-management restriction, tampering, criminal activity, or other material breach.
19. Lost Shipment to an End Buyer
If a device is lost while being shipped by CacheWood to an end buyer, any payout not yet due may be withheld until the carrier confirms the loss and the applicable insured-shipment claim is resolved. CacheWood is not responsible for payment to the extent the loss was materially caused by fraud, misconduct, false information, tampering, criminal conduct, or another act by the original owner.
20. No Guarantee of Sale or Timing
For Sell-It-for-You transactions, CacheWood does not guarantee that a device will sell, the date it will sell, a final selling price above the agreed minimum, a particular level of buyer interest, or continued availability of any specific marketplace or sales channel.
21. Electronic Communications and Signatures
By using CacheWood’s services, you consent to receive transaction-related communications electronically, including by email, text message, website communication, or other reasonable electronic means. To the extent permitted by law, agreements, authorizations, acknowledgments, approvals, revisions, and other records may be executed and retained electronically.
22. Fraud Prevention
CacheWood may take reasonable steps to verify identity, ownership, device status, shipping information, and payout eligibility and may pause, decline, cancel, or investigate transactions where fraud, theft, identity misuse, falsified documentation, shipping manipulation, unauthorized ownership, or other unlawful conduct is reasonably suspected.
23. Limitation of Liability
To the maximum extent permitted by law, CacheWood Mobile LLC is not liable for losses caused by circumstances outside CacheWood’s reasonable control or by the owner’s fraud, misconduct, criminal activity, inaccurate information, breach of these Terms, improper shipping or packaging, undisclosed financing, ownership claims, account locks, lost/stolen status, fraudulent insurance claims, or failure to preserve personal data. Nothing in these Terms limits liability that cannot legally be limited.
24. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, costs, liabilities, and reasonable expenses arising from your fraud, unlawful conduct, material misrepresentation, false ownership claim, undisclosed financial obligation, or material breach of these Terms or an applicable transaction agreement.
25. Compliance With Law
Transactions are subject to applicable federal, state, and local laws. CacheWood may request identification, records, signatures, or other documentation required for legal, regulatory, fraud-prevention, tax, payment, secondhand-goods, or law-enforcement purposes.
26. Separate Transaction Agreements
These Terms establish general rules. A specific Direct Buyout or Sell-It-for-You transaction may also be governed by a separate transaction agreement covering the device identity, IMEI or serial number, condition, final purchase amount, minimum authorized sale price, commission, approved promotional expenses, transaction-specific costs, and other device-specific terms. Where a transaction agreement contains transaction-specific provisions that differ from these Terms, the transaction agreement controls to the extent stated there.
27. Changes to These Terms
CacheWood Mobile LLC may revise these Terms from time to time. Material changes apply prospectively unless otherwise required by law. A transaction already governed by an executed agreement remains subject to the version applicable to that transaction unless the parties validly agree otherwise.
28. Governing Law
These Terms and transactions entered into with CacheWood Mobile LLC are governed by the laws of the State of Florida, except where applicable federal law or another controlling law provides otherwise.
